GENERAL TERMS AND CONDITIONS 


1.0 General 


1.1 The following general terms and conditions ("GTCs") apply to all contracts that you enter into with NASURI GmbH ("NASURI") by way of the online shop on the website www.nasuri.com. By placing your order, you declare your agreement with our general terms and conditions.

1.3 The content at www.nasuri.com and these GTCs are subject to change at any time. The version in force at the time when the contract is entered into is applicable. All content at www.nasuri.com is copyrighted and may not be reused without NASURI's express consent. 

 

2.0 Entry into contract
 

The products in our online shop at www.nasuri.ch constitute a nonbinding catalog. You can add products to the shopping cart and later remove them. When you click on "Buy now" in the shopping cart, you complete your purchase. At that point your order becomes binding. Immediately thereafter, you will receive order confirmation from NASURI by email. Receipt of that confirmation represents the formation of the contract between you and NASURI. 

 

3.0 Prices, taxes, and delivery 


3.1 We charge all prices in euros (€), dollars ($), or Swiss francs (CHF). The currency that applies to you is the one in which the prices are indicated upon completion of the order. 


3.2 Depending on the country of destination to which the product is to be delivered, value-added tax as well as customs duty may be incurred in addition to the purchase price and shipping costs. Our website contains information about the exact amount of value-added tax and custom duty for your country. It is your obligation to pay, in the amount prescribed by law, the value-added tax applicable to the value of the product as well as any customs duty in the country of destination to which the product is delivered. NASURI bears no liability for any failure on your part to properly pay the value-added tax prescribed by law or any customs duty. 


3.3 As buyer, you bear the shipping costs. The amount of shipping costs depends on the place of delivery. The exact amount of shipping costs for your order is displayed in the shopping cart. 


3.4 All of NASURI's products are produced by selected manufacturers in a complex process employing high-quality craftsmanship. You should thus allow 4 to 8 weeks for the production and delivery of your order. This period is a nonbinding estimate.  If the ordered products cannot be delivered for reasons beyond our control, we are entitled to withdraw from the purchase contract in whole or in part. Any payments received from you will be promptly refunded. 

NASURI is not liable for harm caused by delivery delays. 


3.5 You will receive email notification as soon as your products have been shipped. 

 

4.0 Payment options
 

You can choose from among the following means of payment: credit card, PayPal, or payment by bank transfer (prepayment). If you choose the prepayment option, you are responsible for any applicable fees. Moreover, it may take a few days for your payment to reach our account. The delivery time will be extended accordingly. 

 

5.0 No withdrawal from the contract owing to custom production.


5.1 NASURI offers you a completely individualized fashion experience. All products are custom-made and produced according to your specifications. 


5.2 NASURI cannot accept returns of ordered and delivered products. Returns are not possible because the completely individualized nature of the products means that NASURI cannot break them down into their components or resell them to other customers. Withdrawal from the contract is excluded. Therefore, NASURI cannot accept returns of ordered and delivered products. There is no right of revocation. 

 

6.0 Exclusion of warranty 


6.1 Warranty claims owing to defects in purchased items are excluded. 


6.2 Instead, NASURI offers you free repair of the product you have ordered within one year of entry into the contract. You must bear the costs of return shipment. No costs will be refunded if the product is lost during return shipment. 


6.3 Should the product you ordered have a defect, NASURI offers neither a reduction in the purchase price nor return of the item with refund of the purchase price. 

 

7.0 Liability 
 

Except in the case of intent or gross negligence, all claims for damages arising from impossibility of or default in performance, from breach of contract, from fault upon entry into contract, and from tort are excluded. 

 

8.0 Concluding provisions, governing law, venue 


8.1 If individual provisions of these GTCs are invalid, the other provisions remain valid regardless. 


8.2 Except where barred by mandatory provisions to protect consumers, this agreement is governed by the laws of Switzerland. The provisions of the CISG are expressly declared inapplicable. The venue for all performance arising from this agreement is our registered office. The mandatory provisions to protect consumers are reserved.

DATA PROTECTION

Protecting the privacy of the users of our website is very important to us. In this Data protection notice you will learn what data we collect, what we use it for and what rights you have with regard to your data. Most of our content can be used without registration, however, we use industry-standard technologies to measure and improve the performance of our website and collect data for that purpose. In some instances we cooperate with external service providers. If we (or third parties on our behalf) collect and process personal data, we comply with the requirements of the Swiss Data Protection Act. In addition, without being legally obliged, we also orient ourselves according to the requirements of the EU GDPR. This data protection notice explains how we do this.  
 

1.0 WHAT DATA DO WE COLLECT AND FOR WHAT PURPOSES? 
 

1.1 Visiting the Website 
Our website can also be used without disclosing personal data. Our website server, though, temporarily stores information about user access. Information includes the IP address, the date and time of the access, the name and URL of the file accessed, the website from which the access is made (referrer URL), the browser used, the operating system of the computer used and the name of the user's access provider. We use this data to ensure a smooth connection setup, comfortable use of the website, evaluation of system security and stability as well as for other administrative purposes. 
 

1.2 Shopping in the online shop 
When you order our products in our online shop, we conclude a sales contract with you. We collect and process the following data on the basis of this contractual relationship: First name, surname, billing and delivery address, email address, billing and payment data, date of birth and telephone number. We store these data for the duration of the contract and beyond that until the end of the periods determined by the law for the fulfilment of our legal storage obligation. When processing payments, we forward your payment information to third parties (e.g. credit card payment to your credit card provider), depending on the type of payment you require. When we deliver the products you have ordered, we work closely with our shipping partner. For the purpose of delivery, we transmit the following data to the shipping partner: First name, surname, postal address and, if applicable, your email address and telephone number.
 

1.3 Setting up a customer account 

For a completely comfortable and simple shopping experience, we offer you the permanent storage of your personal data in a password-protected customer account. In this way, you do not have to re-enter your data each time you make a purchase. Setting up a customer account is voluntary. 

When you create a customer account, you choose a password. This password, together with your email address, is used to access your customer account. Please treat your access data confidentially and do not pass them on to third parties. You have the possibility to delete your customer account at any time.
 

1.4 Subscription for the NASURI NEWSLETTER

If you have subscribed to the NASURI NEWSLETTER, we will use your e-mail address to send you the newest trends and offers. You can unsubscribe at any time (via the link in every News Alert or by e-mail to info@nasuri.com). In addition to the e-mail address required for registration, you are free to provide your name and, if applicable, a company name. Our legitimate interest to inform you about our services forms the basis of this data processing.
 

1.5. Using the Contact Form
 
The contact form on our website gives you the opportunity to contact us. To use the contact form, you must enter your name and e-mail address. The personal data collected in this way will be deleted within 30 days of your request being processed. Your consent forms the basis of this data processing.
 

1.6 Data processing for advertising purposes
 
We share the latest trends and products with our customers. In doing so, we orient ourselves to the needs of our customers. If we use your data for advertising purposes, we process first name, surname, postal address and year of birth.
 

2.0 HOW DO WE USE COOKIES ON OUR WEBSITE?
 
To optimize our offer, we use cookies on our website. These are text files that are stored on your computer and enable the analysis of the use of our website. You can configure your browser in a way that no cookies are stored on your computer or so that a warning is always displayed before a cookie is installed. A complete deactivation of cookies may result in the website not functioning or not functioning completely. The data processed through cookies is required for the above-mentioned purposes in order to safeguard our legitimate interests.
  

3.0 HOW DO WE USE WEB ANALYSIS TOOLS?

Through the measures listed below, we ensure the needs-based design and continuous optimization of our website. These measures allow us to statistically record and evaluate the use of our website. This is our legitimate interest. We use Google Analytics, a web analytics service provided by Google Inc. (Google). Google Analytics uses cookies to analyze how you use the website. The information generated by the cookie about your use of the website is usually transmitted to and stored on a Google server in the USA. We only use Google Analytics with activated IP anonymization. This means that your IP address will be shortened in Switzerland, the European Union and the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the USA and shortened there. Google will use this information on our behalf to evaluate your use of the website in order to provide us with reports on the activities of users on the website and to provide other services related to the use of the website and internet usage. Furthermore, Google will transfer this information to third parties if required by law or if third parties process this data on behalf of Google. The IP address provided by your browser will not be merged with Google's other data. You may object to Google Analytics collecting the data with effect for the future by installing a deactivation add-on (http://tools.google.com/dlpage/gaoptout?hl=en) for your browser. Besides the possibility to install the deactivation add-on, there is another alternative to prevent Google Analytics from collecting the data. You thereby install a so-called opt-out cookie that prevents the tracking of data on the website. The function remains until the opt-out cookie is deleted. 4.0 WHY DO WE USE SOCIAL MEDIA PLUG-INS?
 
Social media plug-ins are used on our website to facilitate recommending and sharing our articles on the social networks LinkedIn, Xing, Twitter and Facebook. Responsibility for data protection compliant operation lies with the respective providers. Data will only be transferred to the mentioned providers if you are logged in with your profile on the corresponding social network. We have neither influence nor access to cookies which are placed by providers of social networks. For this reason, reference is made to the privacy statement of the relevant provider.
  

5. DO WE DISCLOSE YOUR DATA TO THIRD PARTIES?
 
We only disclose your personal data to third parties if you expressly consent, if there is a legal obligation or permission to do so, if disclosure is necessary to assert, exercise or defend legal claims, or if the disclosure of data is necessary for the settlement of the terms and conditions of the contract with you.
 

6. HOW SECURE IS YOUR DATA?
 
We use technical and organizational measures to protect your data against manipulation, loss, destruction or unauthorized access by third parties. When you visit our website, the SSL encryption method is used.
  

7. WHAT ARE YOUR RIGHTS REGARDING YOUR DATA?
 
You have rights of access, rectification, erasure, restriction of processing, data portability, to revoke your consent and to object. If you believe that the processing of your data violates the data protection laws, you can report this to us or the relevant supervisory authority.  
 
You have the right to object to our data processing that is based on our legitimate interest or that occurs for direct marketing purposes.

We reserve the right to change this data protection notice at any time. Changes will be published on the website.
